This Privacy Policy describes how Lera Living LLC (“we,” “our,” or “us”) collects, uses, shares, and protects personal information through the website of our residential community and any other Lera Living LLC managed property websites (collectively, the “Sites”).

By visiting any of our Sites or submitting information through them, you acknowledge that you have read and understood this policy. If you do not agree with how we handle personal information, please do not use our Sites.

This policy does not govern information collected under the terms of a signed lease agreement. Residents should refer to their lease and any accompanying addenda for information about how we handle data collected in the context of their tenancy.

In limited circumstances, and in the course of evaluating applications or administering our communities, we may collect or receive information that is considered “sensitive data” under applicable law. Where applicable law, including the Texas Data Privacy and Security Act, requires your consent before we process sensitive data, we will obtain your consent before doing so, and you may withdraw that consent at any time using the contact methods described in this policy. We process sensitive data only as permitted by, and in accordance with, applicable law.

We do not sell, rent, or trade your personal information to third parties. We share your information only in the following circumstances.

Service Providers

We work with trusted third-party companies that provide services on our behalf, including website hosting, analytics platforms, applicant screening services, resident portal software, and email delivery services. These providers are permitted to use your information only to perform services for us and are contractually required to protect it.

Property Owners

As a management company, Lera Living LLC manages properties on behalf of property owners. Where required by our management agreements, we may share resident and applicant information with the property owner of the community you are inquiring about or residing in.

Legal Requirements

We may disclose your information when required to do so by law, court order, or governmental authority, or when we reasonably believe disclosure is necessary to protect our rights, your safety, or the safety of others.

Business Transfers

If Lera Living LLC transfers management of a property, or if our company is acquired or merged with another organization, your personal information may be transferred as part of that transaction. We will notify you of any such change that materially affects how your data is used.

✔  We will never share your personal information with third-party advertisers for their own marketing purposes, or sell your data to data brokers or list aggregators.

Regardless of your location, we provide the following rights with respect to your personal information. You have the right to access a summary of the personal information we hold about you. You have the right to request correction of inaccurate or incomplete information. You have the right to request deletion of your personal information, subject to any legal or contractual retention obligations. You have the right to opt out of marketing communications at any time using the unsubscribe link in any marketing email or by contacting us directly. You have the right to request a portable copy of data you have provided to us. Where we rely on your consent to process your data, you may withdraw that consent at any time.

Texas Residents. If you are a Texas resident and the Texas Data Privacy and Security Act applies to our processing of your personal data, you may have the right to: (i) confirm whether we process your personal data and access that data; (ii) correct inaccuracies in your personal data; (iii) delete personal data provided by or obtained about you; (iv) obtain a portable copy of personal data you previously provided to us, where technically feasible; and (v) opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. Lera Living does not sell personal data, process personal data for targeted advertising, or conduct profiling in furtherance of decisions that produce legal or similarly significant effects. These rights are subject to the exceptions and recordkeeping obligations set forth in this policy and in applicable law, including those described in Section 8 (Data Retention). You may exercise these rights using the contact methods described in this Privacy Policy. We will not discriminate against you for exercising your rights.

Appeals. If we decline to take action on your request, we will notify you of our decision and the reason for it, and we will provide instructions for appealing the decision. You may submit an appeal by contacting us at info@leraliving.com with the subject line “Privacy Request Appeal” or by using the request method described above. We will respond to your appeal in writing within the time required by applicable law and will explain the reason for our decision. If we deny your appeal, we will provide information about how you may submit a complaint to the Texas Attorney General.

  1. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required by law. Specifically:

▸  Inquiry and contact form data is retained for up to 24 months from the date of submission.

▸  Rental application data is retained for a minimum of 3 years in accordance with fair housing record-keeping requirements.

▸  Resident data is retained for a minimum of 7 years following the end of a tenancy, or longer if required by applicable law.

▸  Analytics and site usage data is retained in aggregate, anonymized form for up to 36 months.

Effect on Deletion Requests. Your right to request deletion of your personal information is subject to these retention periods and to our legal and regulatory recordkeeping obligations. In particular, we are required to retain rental application and tenant-selection records in order to demonstrate compliance with the federal Fair Housing Act and related fair housing recordkeeping requirements. Accordingly, we may decline a deletion request, in whole or in part, where retention is necessary to comply with a legal obligation, to establish, exercise, or defend a legal claim, or as otherwise permitted by applicable law. Where we deny a deletion request on this basis, we will retain only the data necessary for the applicable purpose, will not use it for unrelated purposes, and will delete or de-identify it once the applicable retention period has elapsed.

We implement reasonable and appropriate technical and organizational measures to protect your personal information against unauthorized access, loss, misuse, alteration, or disclosure. These measures include encryption of data transmitted between your browser and our Sites (SSL/TLS), access controls limiting personal data access to authorized personnel, regular review of our security practices and those of our service providers, and secure server environments for systems hosting personal information.
